Joshua D. Jewkes
Joshua Jewkes focuses his practice on the preparation and trial, before federal and state courts, of cases involving a broad range of business-oriented substantive law issues, including products liability, employment matters, breach of contract, indemnification, environmental tort, consumer fraud, deceptive business practices, oil and gas litigation, insurance coverage, accountant and auditor liability, and bankruptcy litigation. He has experience defending financial institutions, manufacturers and sellers of consumer products and services, and other large corporate clients in class actions, qui tam suits and other complex cases in venues across the nation, including courts located in Georgia, South Carolina, Illinois, Indiana, California, Texas, and Delaware. Josh has also cost effectively resolved numerous commercial disputes for clients by pursuing creative litigation strategies, and by obtaining favorable results short of trial.
Prior to joining Ashe Rafuse & Hill, Josh practiced for several years at a large international law firm in Chicago. He received his B.A. degree from Brigham Young University in 1999, and his J.D. degree, magna cum laude, from the J. Reuben Clark Law School at B.Y.U. in 2002, where Josh was a merit scholar and member of the Order of the Coif and served on the Managing Board of the B.Y.U. Law Review. Josh is fluent in Swedish and speaks Dutch as well. He is admitted to practice in Georgia and Illinois, as well as several federal district and appellate courts across the country. Josh and his wife Dagmar, who has a Ph.D in biomechanical engineering, are the proud parents of twin daughters. He and his family live in Fayette County.
Representative Experience:
- Obtained a $10 million jury verdict on behalf of a cable television set-top box manufacturer in a complex breach of contract and indemnification lawsuit in federal court.
- Successfully defeated a multi-state class action challenging the royalty payments of a major integrated oil and gas company.
- Successfully defeated a nationwide class action alleging deceptive business practices and violations of the Telephone Consumer Protection Act (TCPA) of 1991.
- Nationwide defense of multi-billion dollar qui tam suit brought against the oil and gas industry.
- Obtained voluntary dismissal on behalf of major accounting firm in multi-million dollar malpractice and fraud suit.
- Obtained voluntary dismissal on behalf of a large international bank in complex, multi-million dollar investment dispute.
- Successful representation of employers in state wage and hour claims.
- Obtained reversal by the Seventh Circuit Court of Appeals of unfavorable trial court opinion in a contract suit to obtain indemnification from insurance company for environmental liabilities.
