Scott M. Lenhart

As a member of the Firm’s Employment Law Group, Scott Lenhart has practiced in state and federal courts throughout the country, representing clients in employment and civil rights matters, including claims brought pursuant to Titles II and VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Fair Labor Standards Act, Section 1981 of the Civil Rights Act of 1866, the Family and Medical Leave Act, and the National Labor Relations Act.

Scott also regularly negotiates and drafts executive agreements and other employment contracts containing restrictive covenants, including non-competition, non-solicitation, and nondisclosure provisions. When needed, he also represents companies and individuals in litigation arising out of the enforcement of such agreements.

Scott graduated cum laude from The University of Georgia School of Law. While in Athens, he was the Senior Notes Editor of The Georgia Journal of International and Comparative Law and a member of the Mock Trial Board. He also was active in the Law School’s Public Interest Practicum, which provided legal services to the indigent Athens community.

An English honors graduate of Davidson College, Scott continues to maintain close ties with and friends from his alma mater. After college, he went on to teach English in Japan, where he lived for two years in the city of Numazu, as part of the Jet Program.

When not at his desk, Scott enjoys the outdoors. He spends as much time as possible with his wife Phoebe, an ophthalmology resident at Emory University, whitewater canoeing, hiking, and biking.

Representative Experience

  • Obtained summary judgment on all claims and secured award of costs on behalf of a national restaurant chain in a public accommodation action brought under Title II of the Civil Rights Act of 1964 and Section 1981 of the Civil Rights Act of 1866.
  • Successfully defended a national restaurant chain in a bench trial of a public accommodation action, resulting in the dismissal of all claims and the award of costs against plaintiffs.
  • Counseled various companies nationwide in downsizing efforts and other layoffs and negotiated favorable executive severance agreements.
  • Obtained dismissal of a state court action brought by a former employer against an executive based on overbroad restrictive covenants.
  • Negotiated collective bargaining agreements and secured favorable labor arbitration awards on behalf of employers around the country.
  • Represented clients in connection with employment discrimination and harassment claims in federal and state courts nationwide and before various administrative agencies.
