The following is a sample list and descriptions of recent cases litigated by our lawyers:

Holt v. Rite Aid Corp., 333 F. Supp. 2d 1265 (M.D. Ala. 2004) – In this Section 216(b) collective action brought under the Fair Labor Standards Act, 29 U.S.C. § 201 et seq. challenging the classification status of Store Managers and Assistant Store Managers, Daniel Turner and Kalin Light successfully obtained denial of Plaintiffs’ Motion for Conditional Certification in its entirety.

McDermott, et al. v. Cracker Barrel Old Country Store, Inc., - Civil Action No. 4: 99CV0001HLM (N.D. GA.) – Lawrence Ashe and Tracey Barbaree defended this 29 U.S.C. 216(b) collective action brought under the Fair Labor Standards Act in which the Court recently decertified the class with respect to and granted summary judgment on the claims of tipped employees.

Paulson et al. v. Rite Aid Corporation - Civil Action No. 03-2731 Ma/A (W.D. Tenn.) – Dan Turner led the defense of this alleged nationwide collective action by pharmacists for claimed FLSA violations. Plaintiffs dismissed their individual and collective claims with prejudice following Plaintiffs’ depositions.
