The following is a sample list and descriptions of cases litigated by our lawyers:

In re: CVS Caremark Corp. Wage & Hour Employment Litigation, 684 F. Supp. 2d 1377 (J.P.M.L. 2010) Nancy Rafuse and Jim Swartz defeated an effort to centralize challenges to the exempt status of ASMs. The MDL found that "the record suggests that discovery in each action is likely to involve individualized, location-specific examination of things such as a particular ASMs job duties and the specific tasks assigned to them in a given store or locality."

King v. CVS Caremark Corp., 2008 WL5973490 (S.D. Fla 2008) In this Section 216(b) collective action, employees alleged off the clock claims. Nancy Rafuse and Jim Swartz successfully obtained an order decertifying the class.

Holt v. Rite Aid Corp., 333 F. Supp. 2d 1265 (M.D. Ala. 2004) – In this Section 216(b) collective action brought under the Fair Labor Standards Act, 29 U.S.C. § 201 et seq. challenging the classification status of Store Managers and Assistant Store Managers, Nancy Rafuse and Kalin Light successfully obtained denial of Plaintiffs’ Motion for Conditional Certification in its entirety.

McDermott, et al. v. Cracker Barrel Old Country Store, Inc., - Civil Action No. 4: 99CV0001HLM (N.D. GA.) – Lawrence Ashe defended this 29 U.S.C. 216(b) collective action brought under the Fair Labor Standards Act in which the court decertified the class with respect to and granted summary judgment on the claims of tipped employees.
